GST›CGST Act, 2017›Chapter XIX, Offences and Penalties

At a glance

Entitlement and conditions

  • 125A contravention of the Act or rules for which the Act provides no separate penalty attracts a penalty up to twenty-five thousand rupees.

Procedure, powers and definitions

  • 125The law does not settle which other charges displace this penalty or whether its ceiling applies per contravention, person, period or proceeding.

A person contravening the Act or its rules faces the general penalty only where the Act provides no separate penalty for that breach. The maximum is twenty-five thousand rupees. This makes the existence of a specific penalty decisive, while the section leaves unresolved how fees, interest, fines or penalties prescribed only in rules affect that condition.[1]

Unsettled questions

The words of section 125 do not answer these questions. Where one decides a matter on the file, the answer depends on the position taken on it.

  1. What makes a penalty "separately provided for in this Act", and does a late fee, interest, a fine, or a penalty fixed by a rule rather than by the Act displace section 125?
  2. Does the ceiling of twenty-five thousand rupees run per contravention, per person, per period, or per proceeding? The section names no unit.
