Entitlement and conditions

  • Rule 45(4)Goods not returned within section 143’s period are deemed supplied by the principal on their original dispatch date. The rule requires FORM GSTR-1 reporting and payment of tax with applicable interest.

Bars, duties and time limits

  • Rule 45(3)Dispatch and receipt challan details enter FORM GST ITC-04 by the twenty-fifth day of the month after the specified period. The Commissioner may extend the deadline, and State or Union territory extensions are deemed adopted.

Procedure, powers and definitions

  • Rule 45(1)–(2)The principal’s challan covers dispatch, including direct dispatch, and contains rule 55 details. A principal or sending job worker may issue a challan for onward movement. Job workers may successively endorse the principal’s challan with quantity and description for onward movement or return.
  • Rule 45(3), ExplanationFor a principal whose preceding-year aggregate turnover exceeds five crore rupees, the specified period is six consecutive months beginning on 1 April and 1 October. Otherwise it is the financial year.
  • Chapter ExplanationCapital goods include plant and machinery as defined in section 17. For the specified exempt-supply calculation, land and building use stamp-duty value and securities use one per cent of sale value.

A principal must send inputs, semi-finished goods and capital goods for job work under a challan, including direct dispatches. Rule 45 permits specified job-worker challans and endorsements for onward movement or return. It also requires periodic FORM GST ITC-04 reporting. Failure to return goods within section 143’s period triggers the deemed-supply treatment, tax and interest described in the rule.[1]
